2. Service Delivery

All services are delivered as described in individual service agreements. Timelines are estimates and may be adjusted based on data availability and client cooperation. BrandPulseWorks will communicate any changes promptly.

3. Client Obligations

Clients must provide accurate information, timely feedback, and necessary access to relevant brand assets and data sources. Delays caused by client inaction may impact delivery timelines.

4. Intellectual Property

All deliverables, reports, and strategies created by BrandPulseWorks remain our intellectual property until full payment is received. Upon payment, clients receive a perpetual license to use deliverables for their business purposes.

5. Confidentiality

Both parties agree to maintain strict confidentiality regarding proprietary information shared during the engagement. This obligation survives termination of the agreement for 36 months.

6. Limitation of Liability

BrandPulseWorks shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the total fees paid for the specific service giving rise to the claim.

Refund requests submitted within 7 days of service initiation and before substantial work has commenced may be eligible for a full refund minus administrative fees of 10%.

2. Partial Refunds

If services have been partially delivered, a pro-rated refund may be issued based on the percentage of work completed. Completed milestones and deliverables remain billable.

3. Non-Refundable Items

Setup fees, research data acquisition costs, and third-party tool subscriptions purchased on behalf of the client are non-refundable.

4. Refund Process

Refund requests must be submitted in writing to [email protected]. Processing takes 14-21 business days from approval.

5. Dispute Resolution

Any disputes arising from refund requests shall be governed by German law and subject to the exclusive jurisdiction of the courts in Berlin, Germany.
